  1. Overview of The Same Mountain

    1. The Same Mountain is a high-quality, evidence-based provider of clinical psychology therapy, supervision and training. 

  2. Structure of Online Training

    1. The Same Mountain will provide you with Terms & Conditions and Privacy Policy. Consent to these policies must be given to proceed with online courses. 

    2. All course content is provided via the thinkific platform, including pre-recorded content and handouts.

    3. You consent to receive marketing emails from us. We will never spam you and you can unsubscribe at any time.

  3. Privacy and Disclosure of Personal Information

    1. As part of your participation in the The Same Mountain Program, The Same Mountain needs to collect and record your information.

    2. We require your consent to our Privacy Policy before you can access our online training.

  4. Technology Requirements 

    1. The Same Mountain online training is provided online through the online LMS, Thinkific. You are responsible for the costs associated with setting up the technology needed so you can access and participate in the course. There are no registration costs for using the LMS.

    2. You will need access to:

      1. A computer (preferred), tablet or phone with speakers or headphones.

      2. An internet connection.

    3. Acknowledgement of Risk in Technology:

      1. The Same Mountain may use email to deliver some services to augment or follow up on online training. In these cases, we may provide updates, invoices, account statements, educational resources or exchange information. Based on the nature of the service provided, these email communications may include information about you.

      2. Any communications provided by the The Same Mountain are intended for you and not for others, unless agreed to otherwise. By agreeing to this informed consent, you are confirming to  The Same Mountain that you have taken reasonable steps to secure the electronic devices you choose to use to communicate with The Same Mountain. This would include having a confidential password and adequate firewalls. You further agree not to allow others access to any communications sent to you from The Same Mountain unless an agreement is reached in advance that the particular communication is appropriate to share with others. (Please see separate Privacy Policy for more information on privacy). 

  5. Conditions of Purchase and Intellectual Property

    1. The Same Mountain’s website, training materials, and all content provided within is the intellectual property of The Same Mountain.

    2. The reproduction, exploitation, redistribution or use of all or part of any visual, auditory or software element or document from The Same Mountain’s Website or the The Same Mountain Program is prohibited.  You may not distribute or commercially exploit the content except with our express written permission. Nor may you transmit it or store it on any other website or other forms of electronic retrieval system.

    3. The Same Mountain expressly reserves all copyright and trademark in all documents, information and materials on our website and provided as part of The Same Mountain. We reserve the right to take action against you if you breach any of these terms.

    4. If you are in the business of creating similar documents, goods or services for the purpose of providing them for a fee to users, whether they be business users or domestic users, then you are a competitor of The Same Mountain. The Same Mountain expressly excludes and does not permit you to use or access our website or training, to download any documents or information from its website or obtain any such documents or information through a third party. If you breach this term then The Same Mountain will hold you fully responsible for any loss that we may sustain and further hold you accountable for all profits that you might make from such unpermitted and improper use. The Same Mountain reserves the right to exclude and deny any person access to our website, training, services or information in our sole discretion.

  6. Fees

    1. Online training fees are clearly stated at the time of registration and are inclusive of all course content. Fees are payable in full before course commencement.

    2. For Australian participants, GST is included in the price, and a tax receipt can be issued upon request.

  7. Cancellation & Refund Policy

    1. The Same Mountain handles returns and processes refunds in accordance with the Australian Consumer Protection legislation.

    2. Should you wish to obtain a refund, please notify us within 14 days of purchase with a valid reason. All refunds are made at the sole discretion of The Same Mountain.

  8. Waiver

    1. You acknowledge that "See you in Court Webinar" provided by The Same Mountain is not a substitute for individual supervision.

    2. You should consult with your professional supervisor, lawyer or insurer for personalised recommendations for your situation. 

    3. You agree that:

      1. You need to make your own inquiries to determine if the information is appropriate for your intended use.

      2. In no event will we be liable for any loss or damage, including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising out of, or in connection with, the use of The Same Mountain products and services.

      3. Through our website, products and services you may be able to link to other websites which are not under the control of The Same Mountain. We have no control over the nature, content and availability of those websites. The inclusion of any links does not necessarily imply a recommendation or endorse the views expressed within them.
